General Terms and Conditions (GTC)

§ 1 Applicability and Definitions
(1) These GTC apply to all orders placed via the online shop of WM aquatec GmbH & Co. KG, Uracher Straße 22, 73268 Erkenbrechtsweiler.
(2) A "Consumer" is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.
An "Entrepreneur" is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their commercial or self-employed professional activity.
§ 2 Conclusion of Contract and Storage of the Contract Text
(1) Orders are placed via the online shop at https://wm-aquatec.de.
(2) Product displays in the online shop do not constitute a binding offer.
(3) The contract is concluded as follows:
- Selection of products
- Adding to cart
- Calling up the order summary
- Entering address and payment details
- Confirmation of the GTC and right of withdrawal information
- Completion by clicking "Buy now"
The confirmation of the conclusion of the contract will be sent by e-mail within 3 working days.
(4) The contractual partner is WM aquatec GmbH & Co. KG, Uracher Straße 22, 73268 Erkenbrechtsweiler.
(5) The contract text is not stored permanently. The customer can save it before submitting the order (e.g., via the browser's print function).
(6) Input errors can be corrected using browser functions or by canceling the ordering process.
(7) The customer is responsible for providing a functional and correct e-mail address for the delivery of all contractual information.
§ 3 Subject Matter of the Contract and Essential Characteristics
(1) The subject matter of the contract is the sale of goods as offered in the shop.
(2) Essential characteristics of the products can be found in the respective item description.
(3) For digital products, additional restrictions may apply (e.g., software requirements) as indicated in the product description.
§ 4 Prices, Shipping Costs, and Delivery
(1) All prices are total prices including statutory taxes.
(2) Payment is generally made in advance, unless another payment method is offered.
(3) Any shipping costs will be clearly displayed in the shopping cart and before completing the order.
(4) Delivery time: 1–3 working days after receipt of payment, unless otherwise stated.
(5) Delivery is made to the following countries: AT, BE, BG, CY, CZ, DE, DK, EE, ES, FI, FR, GR, HR, HU, IE, IT, LT, LU, LV, MT, NL, PL, PT, RO, SE, SI, SK.
§ 5 Right of Retention and Retention of Title
(1) A right of retention exists only for claims arising from the same contractual relationship.
(2) The goods remain our property until full payment.
§ 6 Right of Withdrawal
Consumers have a right of withdrawal in accordance with our separate withdrawal policy.
§ 7 Liability
(1) Our liability for simple negligence is excluded, except in cases of injury to life, limb, health, or essential contractual obligations.
(2) In cases of slight negligence, we are liable for damages only within the scope of foreseeable, typical contractual damages.
§ 8 Contract Language
The contract language is exclusively German.
§ 9 Warranty
(1) The statutory warranty rights apply.
(2) For entrepreneurs, the warranty period is 12 months.
(3) Consumers are requested to report obvious defects or transport damage upon receipt. This does not affect the statutory warranty claims.
§ 10 Final Provisions and Dispute Resolution
(1) German law applies. This choice of law applies to consumers only insofar as it does not deprive them of mandatory provisions of the law of the state in which they reside.
(2) The UN Convention on Contracts for the International Sale of Goods does not apply.
(3) The place of jurisdiction for entrepreneurs is the registered office of the provider.
(4) Online dispute resolution: The European Commission provides a platform for online dispute resolution (ODR):

We are not obligated and unwilling to participate in a dispute resolution procedure before a consumer arbitration board.
